5-YEAR LIMITED WORKMANSHIP WARRANTY
LIMITED WARRANTY COVERAGE
Nova Surfaces LLC. warrants the installation of products to be free from defects in workmanship from the date of installation of the product for a period of five (5) years thereafter. Nova Surfaces LLC. agrees to repair or replace, without cost to Owner(s), any defective work and any damages caused by faulty workmanship and/or faulty installation done by Nova Surfaces LLC. or by persons under contract to Nova Surfaces LLC. for five (5) years following completion.
Nova Surfaces LLC. will not be responsible for defects in products covered by a manufacturer’s warranty, but will assume responsibility for correcting improper installation of such products. In no event does Nova Surfaces LLC. warrant the installed products.
Upon proper written notification of any alleged defect in workmanship as set forth below, Nova Surfaces LLC. shall have the right to inspect the areas at issue to determine the cause of the alleged defects. If the alleged defect are determined to be within the scope of this Limited Workmanship Warranty, Nova Surfaces LLC. shall make the necessary repair at Nova Surfaces LLC.’ sole expense. Nova Surfaces LLC. repair of the defect shall be the sole exclusive remedy available to the Owner(s).
Nova Surfaces LLC. will not refund and/or pay any costs in connection with repairing any alleged defects if said repairs are performed by any entity and/or person other than Nova Surfaces LLC..
CONDITIONS OF LIMITED WORKMANSHIP WARRANTY
Nova Surfaces LLC. liability to the Owner shall be subject to the following terms and conditions:
1- The Owner must provide proof that they are the Owner covered by this Limited Workmanship Warranty;
2- The Owner shall notify Nova Surfaces LLC. in writing of any alleged defects that need to be made or adjusted. The Owner shall provide notice within thirty (30) days of discovery of the alleged defects and prior to performing any permanent repair by the Owner or some other entity and/or person. The notice must describe the location and details of the alleged defects and such information as is necessary for Nova Surfaces LLC. to investigate the claim; and
3- Upon discovery of any alleged defects, the covered Owner must immediately, and at the Owner’s expense, provide for protection of all property that could be affected until the defects are remedied.
EXCLUSIONS
Nova Surfaces LLC. will not be responsible for damage to any times caused by fire, wind, flood or other natural causes, as well as damage caused by war, vandalism, crime, unless damage can be attributed to installation by Nova Surfaces LLC.. Nova Surfaces LLC. will not be responsible for damage to items that have been abused, neglected, misused, or otherwise purposely damaged by Owner. Nova Surfaces LLC. will not be responsible for repairs or alternations made by anyone other than Nova Surfaces LLC., settlement or structural movement, movement of materials to which installed products are attached, damages from incorrect design of the structure, acts of God, including, but not limited to, hurricanes, tornados, floods, earthquakes, severe weather or other natural phenomena, or lack of proper maintenance of an installed product by Owner. All living plants including sod require immediate maintenance from Owner and therefore are not warranted by Nova Surfaces LLC. Nova Surfaces LLC. will not be responsible for splitting, cracking, or warping of treated lumber. Materials that are salvaged from the worksite that are intended to be reused, or for any reason set aside for the owners or others are not warranted against damage, breakage or theft during their removal, storage or re-installation
SETTLEMENT OF CLAIM(S)
Any repairs made by Nova Surfaces LLC. pursuant to this Warranty shall constitute a full settlement and release of all claims of any covered Owner hereunder for damages or other relief and shall be a complete bar to any litigation filed subsequently to the covered Owner’s acceptance of such agreement.
THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, STATUTORY OR OTHERWISE, EXPRESS OR IMPLIED, ALL REPRESENTATIONS MADE BY Nova Surfaces LLC. AND ALL OTHER OBLIGATIONS OR LIABILITIES WITH RESPECT TO THE HOUSE AND/OR STRUCTURE COVERED BY THIS WARRANTY. IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS ARE EXPRESSLY EXCLUDED FROM THIS WARRANTY AND Nova Surfaces LLC.’ OBLIGATION SHALL NOT EXCEED ITS OBLIGATION SET FORTH IN THIS WARRANTY.
This Warranty is Non-Transferable.
